Terms of Service & Privacy Policy
These terms are issued by Todd Tours (ABN 57 260 751 279).
1. Participant Conduct & Safety
1.1 Responsible Service of Alcohol (RSA): Todd Tours promotes the responsible enjoyment of NSW wine regions. We reserve the right to terminate a tour without refund if a guest becomes unruly, disruptive, or breaches RSA guidelines at any venue.
1.2 Vehicle Care & Cleaning: We take pride in our high-quality tour vehicles. Guests are responsible for any damage caused to the vehicle interior or exterior. A professional cleaning fee of $250 AUD may be charged if the vehicle is soiled beyond reasonable “wear and tear.”
1.3 Seatbelts: In accordance with NSW law, seatbelts must be worn at all times while the vehicle is in motion.
2. Itinerary & Accuracy
2.1 Destination Flexibility: While we strive to visit your requested stops (e.g., Mount Pleasant or Tyrrell’s), Todd Tours reserves the right to alter the route due to traffic, weather, or venue capacity to ensure the best possible guest experience.
2.2 Personal Belongings: Todd Tours is not liable for the loss or damage of personal items (cameras, phones, wine purchases) left in the vehicle or at tour venues.
3. Privacy & Data Handling
3.1 Data Collection: We collect your name, email address, phone number, and pick-up details to execute your tour. For group bookings, we collect the first names of additional passengers. Any dietary requirements or access needs you disclose in your booking are held securely and shared with tour venues where relevant to your experience. For the Hunter Valley Helicopter Vineyard Experience, we collect passenger weights for the purposes of the flight weight manifest required by the aviation operator; this information is not retained after the tour date. For direct bookings, data is shared with eWay as our secure payment processor. Bookings made through third-party platforms are subject to those platforms’ own privacy practices.
3.2 Digital Memories: We ask for your consent at the time each photo or video is taken during your tour. If you’d prefer not to be photographed or filmed, you’re welcome to decline at that time. Where consent is given, your photos and/or video may be used by Todd Tours for social media, marketing, and other promotional purposes, and will also be sent to you via WhatsApp, Email, or a private link on our website, linked to the specific tour and date you booked. If you provide your name and email through our post-tour page to receive this material, we use that contact information solely to deliver your photos and/or video and do not add it to any marketing or newsletter list.
3.3 Communication: We may use your contact details to provide tour updates or occasional news regarding the Hunter Valley. We will never sell your data to third parties.
3.4 Access and Correction: You may request access to, or correction of, any personal information Todd Tours holds about you by contacting . We will respond to reasonable requests within a reasonable timeframe.
3.5 Complaints: If you have a concern about how your personal information has been handled, please contact in the first instance. If you remain unsatisfied, you may lodge a complaint with the Office of the Australian Information Commissioner (oaic.gov.au).
3.6 Retention: Booking and guest information is retained for as long as reasonably necessary for business, taxation, and legal record-keeping purposes. Guest weight information collected for the Hunter Valley Helicopter Vineyard Experience is used solely for aircraft weight and balance compliance and is not retained beyond the tour date.
3.7 Third-Party Disclosure: We do not sell or disclose your personal information to third parties except where necessary to deliver your tour (for example, sharing relevant booking details with third-party venues or operators such as wineries or the helicopter operator) or as required by law. Todd Tours does not intentionally disclose personal information overseas; where a third-party service provider we use (for example, payment or booking platforms) may process data outside Australia as part of their own standard operation, this is limited to what is reasonably necessary to provide their service.
4. Nature of Tours and Assumption of Risk
4.1 General activities: Our tours may involve walking (including short walks of up to approximately 40 minutes at some locations), travel in a rented vehicle, and, on applicable tours, travel by scheduled ferry service. You should consider your own fitness, mobility, and any relevant medical conditions before booking, and are welcome to discuss any access needs with us prior to your tour.
4.2 Third-party venues and operators: Some parts of your tour take place at premises or through services we do not own or operate, including but not limited to wineries, restaurants, cafes, markets, and ferry operators. These venues and operators are responsible for the safety, conduct, and standards of their own premises and services. Todd Tours is not liable for the acts, omissions, or conditions of any independent third-party venue or operator.
4.3 Helicopter and specialist activities: Where a tour includes an activity operated by a specialist third-party provider (for example, a helicopter flight operated by a licensed aviation operator), that activity is conducted entirely by the specialist operator under their own operational procedures, licensing, and insurance. You will be required to complete any waiver or disclosure required directly by that operator, separately from your booking with Todd Tours. Todd Tours’ role is limited to coordinating and booking this component on your behalf.
4.4 Weather and circumstances beyond our control: Tours may be modified, rescheduled, or cancelled due to weather, park or venue closures, safety advice from relevant authorities, or other circumstances outside our reasonable control. We will make reasonable efforts to notify you promptly and to offer a suitable alternative where possible.
4.5 Limitation of liability: To the maximum extent permitted by law, Todd Tours’ liability for any loss, injury, or damage arising from your tour is limited to the fullest extent permitted under the Australian Consumer Law and other applicable legislation. Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded.
4.6 Your acknowledgment: By ticking the box at booking, you confirm that you have read and understood this clause, and that you accept the general nature and risks of the activities described above.
